Terms of Service

These Terms of Service ("Terms") govern the software development, artificial intelligence integration, UI/UX design, and technical consulting services provided by Bytevault Infotech ("we," "us," or "our"). By engaging Bytevault Infotech, executing a Statement of Work (SOW), or utilizing our website and services, you ("Client" or "you") agree to be bound by these Terms.

Bytevault Infotech operates as a founder-led engineering team delivering custom software applications, AI models, mobile applications, and web platforms. All specific project deliverables, timelines, and technical requirements are defined in an agreed Statement of Work (SOW) or project proposal.

• Fixed-Scope Engagements: Scopes are strictly defined in writing. Any modifications or feature additions requested during development will be evaluated under a formal Change Request process.
• Dedicated Sprint Engagements: Development proceeds in continuous iteration cycles with direct access to senior engineers.

We believe in complete client control over custom deliverables:

• Client Ownership: Upon full and final settlement of all invoices for a defined milestone or project scope, 100% of all intellectual property rights, source code, design assets, and compiled binaries created specifically for the Client transfer unconditionally to the Client.
• Pre-existing Code & Open Source: Any pre-existing open-source libraries, third-party frameworks, or proprietary tools integrated into deliverables remain governed by their respective licenses (e.g., MIT, Apache 2.0).

Both parties agree to protect and keep strictly confidential all non-public technical code, proprietary business algorithms, trade secrets, and client data shared during engagement. We enforce strict internal data confidentiality and sign formal Non-Disclosure Agreements (NDAs) prior to project kickoff.

Pricing and invoice schedules are structured transparently based on custom quotes or milestone-based sprint pricing detailed in your Statement of Work.

• Invoices are due upon receipt or according to agreed payment terms specified in the contract.
• In the event of overdue payments exceeding 30 calendar days, Bytevault Infotech reserves the right to pause active development until payments are brought current.

We deliver engineered solutions following industry best practices for security, performance, and maintainability:

• Bug Fix Warranty: We provide a post-launch support period (as specified in your contract) to remediate any core functional bugs present in agreed deliverables.
• Limitation of Liability: To the maximum extent permitted by applicable law, Bytevault Infotech shall not be liable for any indirect, incidental, or consequential damages resulting from third-party hosting outages, unapproved code modifications by external developers, or breach of third-party APIs.
